1. Introduction

Italy Escape Guided Tours is a mobile application that enables users to discover cities, towns, villages and parks through interactive games and cultural and video content relating to the locations encountered along each route.

Each route may be offered free of charge or for a fee. Within each experience, the player becomes the protagonist of a story, which may be set in a specific historical period and developed along a cultural and tourist itinerary.

During the game, participants are required to solve riddles and complete challenges. Upon reaching the various stages of the route, they may access cultural content and short video guided tours relating to the monuments and locations encountered.

Each route has an estimated duration. The actual time required to complete it may vary depending on the player's pace, the time taken to solve riddles and complete challenges, and the conditions encountered along the route.

2. Ownership of the Platforms

Italy Escape Guided Tours is a project owned by Unconventional Rome Tours S.r.l. – I Viaggi di Adriano, a tour operator with registered office at Via Abigaille Zanetta 18, Staircase 3, Apartment 3, 00143 Rome, Italy.

These Terms of Use govern access to and use of the Italy Escape Guided Tours mobile application and the ItalyEscapeTours.com website, hereinafter collectively referred to as the “Platforms”.

Before using the app or accessing the website, please read these Terms of Use carefully.

By accessing or using the Platforms, you acknowledge that you have read, understood and agreed to be bound by these Terms of Use.

These Terms of Use may be amended or updated from time to time. Users are therefore encouraged to review them periodically.

Despite the care taken in researching and verifying the information provided, errors, inaccuracies or typographical mistakes may occasionally occur.

5. Operation and Availability of the Platforms

We use reasonable efforts to ensure that the app and website remain accessible and operate correctly.

Such issues may arise for a variety of reasons, including technical circumstances beyond our reasonable control.

Where we become aware of an issue, we will use reasonable efforts to address and resolve it as soon as reasonably practicable.

6. Use of the Routes and User Responsibility

Italy Escape Guided Tours provides game-based experiences designed to enable users to explore and discover real-world locations.

Routes take place primarily in real-world public spaces where participants may encounter traffic, road crossings, uneven surfaces, stairs, obstacles, construction or maintenance works, other pedestrians and other conditions ordinarily associated with urban or natural environments.

Throughout the experience, each participant is responsible for remaining aware of their surroundings and must comply with applicable road traffic laws, signs and signals, safety requirements, instructions issued by the competent authorities and any rules governing access to the locations visited.

The application must never be used in a manner that distracts participants while crossing roads or in any other situation requiring particular care or attention.

To the extent permitted by applicable law, Unconventional Rome Tours S.r.l. shall not be liable for any consequences arising from negligent, reckless, unlawful or otherwise inappropriate conduct by users during the experience.

7. Events and Circumstances Beyond Our Reasonable Control

Unconventional Rome Tours S.r.l. shall not be liable, to the extent permitted by applicable law, for any interruption, obstruction, alteration or restriction affecting a route as a result of circumstances beyond its reasonable control.

Such circumstances may include, without limitation, cultural, sporting, political or religious events or demonstrations, public events, roadworks, temporary closures, access restrictions, measures or orders imposed by competent authorities, adverse weather conditions or other unforeseen circumstances.

It may not always be reasonably possible to identify or anticipate such circumstances in advance.

8. Changes to Routes or Inability to Complete an Experience

We use reasonable efforts to monitor the accessibility and practicability of the routes available through the Platforms.

However, temporary, unexpected or unforeseen circumstances of which we have not been notified may make it difficult or impossible to reach a particular stage or to complete an experience in accordance with the route originally provided.

9. Ownership and Use of Content

All texts, editorial content, graphics, data, layouts, designs, photographs, videos, music, sounds, images, software, HTML elements, interfaces, typefaces, storylines, riddles and any other original content made available through the Italy Escape Guided Tours app or website are protected by applicable intellectual property laws.

Unless otherwise expressly stated, such content is owned by Unconventional Rome Tours S.r.l. or is used pursuant to the necessary licences, permissions or other authorisations.

Except as expressly permitted by applicable law or with the prior authorisation of the relevant rights holder, users may not copy, reproduce, download, distribute, modify, publish, commercially exploit or otherwise use such content for unauthorised purposes.

10. Intellectual Property Rights

Users acknowledge and agree that the app, the website and their respective content, together with all associated intellectual property rights, are owned by Unconventional Rome Tours S.r.l. or by the respective rights holders, as applicable.

Users may not remove, alter, obscure, reproduce or use without authorisation any trademarks, logos, identifying elements, copyright notices or other protected content displayed on or made available through the Platforms.

Any unauthorised reproduction or use of protected content may result in the exercise of the rights and remedies available under applicable law.

11. Third-Party Intellectual Property Rights

We respect the intellectual property rights of third parties and will review any good-faith notification concerning content made available through our Platforms that is alleged to infringe such rights.

If you are the owner of intellectual property rights, or are duly authorised to act on behalf of the relevant rights holder, and believe that any content available through the app or website infringes those rights, you may submit a notice to info@italyescapetours.com.

Your notice should clearly identify the content concerned and provide sufficient information and supporting details to enable us to assess and investigate the alleged infringement.
